  1. Introduction:


Thank you for visiting the E-CONFIRMATION TRAVEL (ECT) website. TERMS AND CONDITIONS OF USE ("Terms and Conditions")

PLEASE READ THIS USER AGREEMENT (THIS "AGREEMENT") CAREFULLY BEFORE USING THE E-CONFIRMATIONTRAVEL.COM WEB SITE (THE "SITE").  YOUR USE OF THE SITE IS EXPRESSLY CONDITION ON YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS.  YOUR USE OF THIS SITE CONSTITUTES YOUR AGREEMENT TO FOLLOW THE TERMS AND CONDITIONS AND TO BE BOUND BY THEM.  IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS, THEN YOU CHOOSE NOT TO USE THIS SITE NOR MOVE FORWARD THE USAGE OF THIS SITE.

You certify to E-CONFIRMATION TRAVEL.COM if you are an individual (i.e., not a corporation) you are at least 18 years of age.  You certify that you are legally permitted to use the Services and access the Site, and take full responsibility for the selection and use of the Services and access of the Site.  This Agreement is void where prohibited by law, and the right to access the Site is revoked in such jurisdictions.

 Using this Site Means You Agree to These Terms:

All content, information, and services described in this Site may be used only according to these Terms. BY USING THIS SITE YOU AGREE TO THESE TERMS. PLEASE READ THE TERMS BEFORE USING THE SITE.  These terms restrict your rights and remedies and provide protection to E-Confirmation Travel and its members. These also include warranty disclaimers and liability exclusions.  By using this Site you acknowledge and agree (a) this is a fair balance because this Site is accessible by you conveniently and at no charge to access the Site; and (b) if you don't agree or don't want to accept these Terms, you can easily choose to not use this Site.  So, if anything is in these Terms, including warranty disclaimers and liability exclusions, that you disagree with or are not willing to be bound by, or if something is missing from these Terms that you consider essential, then you must not use this Site. IF THERE IS ANY PART OF THESE TERMS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS SITE.

3. Your User License:
You are granted a limited, nonexclusive, nontransferable license to access the Site and its content according to these Terms.  You agree not to use this Site in any way that violates any of these Terms. You agree to indemnify defend and hold harmless E-Confirmation Travel and its members from any claim, damage, loss, liability, cost, and expense, including attorneys' fees, resulting from your use or misuse of the Site.

 

4. Site Location:
This Site is hosted in the State of Nevada, USA. We make no representation that any material on the Site is appropriate or available for use in any location or jurisdiction. Accessing this Site is your decision. You are responsible to comply with local laws, including laws on viewing or receipt of contents of this Site, or on the transmission of technical data exported from the USA or the territory where you are located or using this Site to engage in any transaction.

5. Rate Changes:
Most vacations and travel services described in this site are provided by other companies, such as cruise line companies, hotels, private transportation, city tours, and airlines.  Their charges often change and base on availability.  Reasons include changes in currency exchange rates, changes in fuel or other costs, governments imposing or changing taxes and tariffs, their suppliers changing prices, and many other factors.  Prices may vary based on seasonality, weekend, and holiday surcharges, local events, and many other factors.  Itineraries may vary based on departure dates and many other factors.  All prices, even if stated in these terms, can change at any time.

 

6. Personal Expenses:

Travelers are responsible for their own personal expenses with travel vendors. Airline charges, passport and visa fees, inoculations and other optional purchases and charges are examples of personal extras, which are not included.

7. Deposits, Fees, and Cancellation:

A deposit may be required to secure your reservation. Normally full payment is due before departure. For a reservation made closer to departure, full payment may be required with the reservation. Non-refundable reservations cannot be modified or amended.

8. Changes:

Airline tickets are nonrefundable and nontransferable.  Name changes are not allowed.  To changes an existing reservation to origin/destination are permitted, a change fee or cancelation penalty will vary by the airlines; the charge will be per person plus any applicable fees that are subject to additional collection for the new itinerary.  Date changes may be considered a trip cancellation and cancellation charges may apply.  If original rates are no longer available for your changed travel dates, additional charges may apply.  Changes to air tickets, cruise reservations or other travel are subject to service provider rules, change fees, and cancellation policies.  You will be required to pay any charges assessed by the airline, cruise line or other service providers.  Collect any applicable fare difference at the time of reissue. Subject to availability change fees plus applicable fees may apply.  Hotel stay is subject to cancellation if not cancel within the designated hotel cancel the policy. Hotel cancellation may result in your full stay as a cancellation penalty. Pre-pay rental cars are subject to a 50% cancellation fee of the rental amount.

9. If You Cancel:
A cancellation request is permitted, E-confirmation Travel request for a verbal authorization from the traveler and/or credit cardholder. Depending on the cruise, air, and hotel booking the cancellation additional fees may vary by the service provider.  Flight itinerary is non-refundable, subject to a change and cancellation fee and any applicable fare difference, the unused portion of a flight itinerary is valid for one year from its original purchasing datable and may be forfeited, and the cancellation charge may be as much as 100%.  There is no refund for any individual unused service or unused portion of your trip.  Hotel bookings canceled after scheduled departures are subject to a 100% cancellation fee.  Please ask your Travel Specialist for details.

Other fees: The airline may charge additional fees for checked and carry-on baggage or other optional services. E-confirmation Travel will not be responsible or compensate for the airlines and hotel incidental additional fees that may be required for your fees 

9A. Service Charge Fees:

E-Confirmation Travel Service (ECT) will retain service charge fees as additional compensation in servicing your travel and concierge requests. ECT will require a secured payment before the service begins. Customer shall be charged, and agrees to pay, a payment service charge fee of 50.00 USD per new request as research.  A new request will consist of new dates, different destinations, and changes or cancel to an existing itinerary, new research travel plans, and other concierge services. There is no fee for a general question. A travel and concierge request that require to research the service charge fees will associate with a new request.

Complex travel consists of multiple destinations, multiple dates, extensive travel packages, one or more concierge components, a request that requires more than two (2) traveler’s result in a higher service fee 125.00 USD per new request. All transaction service fees are non-refundable and non-transferable are subject to change without notice.

(ECT) rate includes a turnaround response time up to four (4) hours for basic travel (exclude complex travel) and 24-hours for complex travel requests, research, communicate by email and/or telephone, three suggestions quote, and customized itinerary. (ECT) is not responsible or liable when the rate and availability change without notice.

9B. Booking Fees:  

Customer shall agree to pay a booking process fee that can range from $15 to $100 per reservation. Research and quoted service fees will not be waived; if the customer shall confirm the itinerary as quoted; interim rates and availability are subject to change without notice. Confirming with an ECT Travel Consultant, the booking (including complex multi-stop and round-the-world itineraries) may be higher than those charged for bookings made online. All booking service fees are subject to change without notice. You will be charged the final total price as quoted regardless of any change or variance in the service fees. Please review the total final price carefully. 

9C. Taxes and Legal Responsibilities. Customer shall be responsible for payment of all taxes and associated legal responsibilities, and any related interest and/or penalties, resulting from any payments made to authorized users by any individual, entity or company is strictly prohibited unless the individual, entity or company is an authorized agent of (ECT).

10. Program Changes:

Circumstances may require us or a service provider to adjust aspects of your travel.  For example, ports and routes can be affected by weather, water levels, incidents, danger, or other conditions.  Travel destinations could be affected by unanticipated events and the airline could/shall change their flight operations without notice.  Situations may arise when a hotel or other advertised aspect of a tour is not available.  We and service providers reserve the right to make adjustments based on or due to these or other conditions and circumstances and or other changes and/or substitutions, also including, as examples, point of embarking, debarking, mode of travel, schedule, sightseeing itinerary, cancellation of or alternate events, guests, celebrities, other talent or programs, timing, hotel or other accommodations, overall itinerary or any and all other aspects of your travel, whenever in our or their judgment (even if the judgment is incorrect) circumstances or conditions warrant, or we or they deem it appropriate for comfort, convenience, economy, or safety, or for reasons beyond their or our control or other reasons. These changes do not result in you having a right to cancel, or excuse you from paying cancellation fees.  Travelers accept the risks and waive any claim against ECT; and its members for damages, loss, or refund.  E-confirmation Travel is not responsible for any delays, changes, cancelation, with the service provider such as the airline, cruise line, ship, or other participant suppliers.  There is a possibility that the participant supplier will be making a decision,  required, or forced by forces, conditions, circumstances or requirements, in advance, alter, delay, amend, cancel, shorten or lengthen sailing or changing any aspect of the travel, At any event, guest, celebrity, deviate from a stated, planned or usual itinerary or route, omit or change any port(s)-of-call, arrange for approximately equivalent transportation by another vessel and/or other means of transportation, also including without limitation coach or other land transportation, and to cause you to disembark early, late, temporarily or permanently.

11. Trip Insurance:
Unforeseen incidents may occur as you may take a risk of losing your investment in your vacation, we recommend you obtain cancellation and interruption insurance coverage, preferably at the time of booking but in any event as soon as possible.  Your Travel Arranger can discuss insurance with you and there are other available sources of information and/or insurance.

12. Passport:
To confirm your international travel the nations, airlines, and cruise lines require your passport to have validity six months prior/after to your departure date, passport number, date, place of issue, and birth date.  Travel may be conditioned on names on tickets and passport matching exactly.  Your passport must be valid for at least six months after your return to the USA.  Several months may be needed to obtain or renew a passport so please check your Passport now, even if you did not yet reserve travel or do not intend to travel soon. For any questions regarding what the applicable minimum period is and any other conditions or passport/visa requirements for travel, you should contact the corresponding local consulate of the countries to which you are traveling.

13. Providing Tour Documents & Tickets:
Please review your email for your travel itinerary confirmation.  Your Travel Arranger may be able to provide your tour documents by your choice of electronically or hard copy.  You may be required to provide full payment and passenger information.  Please ask your Travel Consultant

14. Traveler Accommodations:
If you have a disability or condition, dietary need or other circumstance or concern for which reasonable accommodations may enable you to use our services, or for which professional attention or special equipment may be needed, please tell your Travel, Arranger.  You should do this before making the reservation, but in any event as soon as possible.  If it arises after travel is booked, please tell your Travel Arranger immediately. The airline, hotel, and cruise line will make reasonable attempts to accommodate you.  Nevertheless, your Travel Arranger and we are not the airline, cruise line, hotel or other travel service provider.  Those providers make final decisions on their services and accommodations.  There may be limits, especially outside the USA, in accommodations.  As an example, availability, assistance with or accessibility to assistive devices or equipment (for example, wheelchairs), especially outside the USA, cannot be assured.  Travelers are responsible to bring and/or notify for any type of accessible device equipment that you need for your travel needs. E-Confirmation Travel will not be responsible for the denial of boarding, rental fees that a participant supplier may assess, or any insufficient accommodations that are required by the airlines, cruise lines, hotel or any other travel service provider.

15. Traveling at Your Own Risk; Exclusion of Liability Regarding Travel:
YOU TRAVEL AT YOUR OWN RISK.  E-CONFIRMATION TRAVEL AND ITS MEMBERS SHALL NOT BE LIABLE FOR PERSONAL OR PHYSICAL INJURY, DEATH, OR DAMAGE, LOSS OF OR INJURY TO LUGGAGE, BAGGAGE, EQUIPMENT, OR OTHER PROPERTY YOU OR PERSONS YOU ARRANGE TRAVEL FOR OR ANY PERSON MAY SUFFER DURING OR IN CONNECTION WITH TRAVEL. THIS ALSO INCLUDES BUT IS NOT LIMITED TO INJURY OR DAMAGE ARISING FROM OR RELATED TO YOUR OR THEIR PHYSICAL OR MENTAL CONDITION, LOSS OF OR DAMAGE TO ASSISTIVE DEVICES OR EQUIPMENT OR OTHER PERSONAL PROPERTY, LACK OF OR INSUFFICIENT ASSISTANCE WITH OR ACCOMMODATION OF SPECIAL NEEDS, UNAVAILABILITY OF MEDICAL ASSISTANCE OR TREATMENT, OR ANY COMBINATION OF THESE. THIS ALSO INCLUDES BUT IS NOT LIMITED TO DAMAGE TO, OR LOSS OF, PROPERTY OR INJURY TO, OR DEATH OF, ANY PERSON CAUSED DIRECTLY OR INDIRECTLY BY ACT OR OMISSION OF ANY OTHER PROVIDER, INCLUDING BUT NOT LIMITED TO DEFECT IN ANY AIRCRAFT, WATERCRAFT, OR VEHICLE, OR IN ITS OPERATION OR MANNER OF OPERATION, INJURY, DEATH, LOSS OR DAMAGE DUE TO DELAY, CANCELLATION, OR DISRUPTION IN ANY MANNER CAUSED BY LAW, REGULATION, ACT OR FAILURE TO ACT, DEMAND, ORDER, OR ACT OF ANY GOVERNMENT, ACT OF GOD, STRIKE, FIRE, FLOOD, WAR, WEATHER, REBELLION, TERROR, INSURRECTION, SICKNESS, QUARANTINE, EPIDEMIC, THEFT, OR OTHER CAUSE(S) BEYOND OUR OR THEIR CONTROL; AND/OR CANCELLATION PENALTY CHARGED BY ANY AIRLINE, CRUISE LINE OR OTHER SERVICE PROVIDER. E-confirmation Travel AND ITS MEMBERS ARE NOT RESPONSIBLE FOR COSTS OF MEDICAL TREATMENT, OR QUALITY OF MEDICAL CARE OR LACK OF MEDICAL CARE. YOU WAIVE ANY CLAIM AGAINST SIGNATURE AND ITS MEMBERS FOR ANY SUCH CLAIM, LOSS, DAMAGE, INJURY, OR DEATH. We urge you to obtain medical, personal injury, property damage and other insurance that covers injury, loss, damage, replacement, diagnosis, treatment, medical evacuation, assistive devices, and other risks.

The Concierge is not liable for any flight delays and/or flight cancellations. Please check your airline for terms and conditions. Any rebooking or refund waiver policies will be communicated by the airline accordingly unless otherwise specified in writing by the Concierge. Please note, admittance into any country is subject to local customs and border protection. In case of refusal of entry into destination or stop-over country, all refunds and rebooking will be subject to the airline’s policy.

The Concierge will not be held responsible or liable in any way for any claims, damages, losses, expenses, costs or liabilities (including, without limitation, any direct or indirect damages for loss incurred).

The Concierge is not liable for any dining reservation and entertainment cancellations. Please contact the Concierge or the venue for the terms and conditions. Any rebooking and pre-authorization charges policies will be communicated by the restaurants and/or accordingly unless otherwise specified in writing by the Concierge. Please note, Michelin, fast-food chain and cafes are among the restaurants across the U.S. stepping up their sanitation efforts amid the Pandemic Virus outbreak. In case of denial of service, it will be the venue or restaurant's discretion to their safety policy.

The Concierge will not be held responsible or liable in any way for any claims, damages, losses, expenses, costs or liabilities (including, without limitation, any direct or indirect damages for loss incurred).

16. Limitation of Liability Regarding this Site:
E-confirmation Travel AND ITS MEMBERS SHALL NOT BE LIABLE FOR ANY DAMAGE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER DAMAGE ARISING OUT OF THE USE OF OR INABILITY TO USE OR DELAY OR ERROR OR INACCESSIBILITY IN USE OF THIS SITE, SERVICE, OR CONTENT, ANY TRANSACTION CONDUCTED THROUGH OR FACILITATED BY THE SITE; ANY CLAIM ATTRIBUTABLE TO ERROR, OMISSION, OR OTHER INACCURACY IN THE SITE, SERVICE OR CONTENT, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR ANY OTHER MATTER RELATING TO THIS SITE, SERVICE, OR CONTENT, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF THE DAMAGE. IF YOU ARE DISSATISFIED WITH THIS SITE, SERVICE, CONTENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THIS SITE.

17. ALTERNATIVE LIMIT:
IN THE EVENT THAT FOR ANY REASON THE ABOVE LIMITS OF LIABILITY ARE NOT ENFORCEABLE OR DO NOT APPLY, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW, AND SHALL, IN NO EVENT, EXCEED TWO HUNDRED FIFTY DOLLARS ($250) EACH TO YOU AND TO EACH PERSON YOU ARRANGE TRAVEL FOR.

18. Independent Contractors:
The services, also including, without limitation, transportation, lodging, and sightseeing, are provided by carriers, hotels, and other suppliers that are independent contractors and not our agents, employees, partners, or joint ventures. Your Family Travel Specialist is an independently owned and operated travel agency, which is a member of, but is not an agent or representative of,

E-CONFIRMATION TRAVEL.COM, and has no authority to obligate or bind. E-Confirmation Travel, and its members. E-Confirmation Travel AND ITS MEMBERS OR ANY TOUR OPERATOR OR TOUR ADMINISTRATOR SHALL NOT BE CONSTRUED AS A CARRIER UNDER CONTRACT FOR SAFE CARRIAGE OF THE PASSENGER OR BAGGAGE AND BELONGINGS.

19. Disclaimer of Warranties:
THIS SITE AND CONTENTS ARE PROVIDED "AS IS," WHERE IS,” "AS AVAILABLE," WITH ALL FAULTS, AND WITH NO WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE UNDER LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO REPRESENTATION OR WARRANTY WHATEVER REGARDING COMPLETENESS, ACCURACY, CORRECTNESS, INTEGRITY, RELIABILITY, CURRENCY, ADEQUACY, SUITABILITY, FUNCTIONALITY, AVAILABILITY, OR OPERATION OR ANY ASPECT OF THIS SITE OR CONTENT OR SERVICES PROVIDED ON, OR ACCESSIBLE FROM, THIS SITE. 20. Restriction on the Disclaimer of Warranties and Exclusions of Damages:
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. THEREFORE, DEPENDING WHICH STATE YOU ARE IN, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU AND YOU MAY HAVE ADDITIONAL RIGHTS.

21. Indemnification:
You understand and agree you are personally responsible for your behavior on this Site. You agree to indemnify, defend and hold harmless, Signature and its members and their respective parent companies, subsidiaries, affiliated companies, joint venture’s, business partners, licensors, members, employees, agents, and any third-party information providers from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys’ fees, resulting from or arising out of your use, misuse, or inability to use the Site, violation by you of this Agreement, and any negligent, willful or other culpable act or omission by you or persons you arrange travel for.

22. Third-Party Web Sites:
Any links on this Site to third-party web sites or information are provided only as a convenience to you. Such links do not express or imply endorsement, sponsorship, or recommendation by us of the third party, the third-party web site, or information therein. We are not responsible for the availability of any such web sites. We are not responsible or liable for any such web site or its content. If you use the links to the web sites of anyone else, you will leave the Site and will be subject to the terms of use and privacy policy applicable to those sites

23. Right to Refuse Service and/or Removal:
We reserve the right to refuse service to you or anyone, in our sole discretion, and without notice.

24. Trademarks and Copyright:
E-Confirmation Travel; our various logos, and all product names, company names, and other logos, unless otherwise noted, are trademarks and/or trade dress, respectively. The use or misuse of any other materials contained on this Site, without prior written consent is prohibited. The Site design, text, content, selection, and arrangement of elements, organization, graphics, images, compilation and other matters related to the Site are protected under copyright laws.

25. You Do Not Acquire Rights in Elements of this Site:
You do not acquire any rights to any elements viewed through the Site. Except as otherwise provided herein, none of these elements may be used, copied, reproduced, downloaded, posted, displayed, transmitted, modified, or distributed in any form or by any means, including, without limitation, electronic, mechanical, photocopying, recording, or otherwise, without our prior written consent.

26. No Copying or Editing:
No material from this Site may be modified, copied, reproduced, republished, downloaded, posted, displayed, transmitted, performed, licensed, used to make a derivative work, transferred, sold or distributed in any way, without our prior written consent.  You may not frame or mirror any material on this Site on any other server or other location.  Unauthorized use of any such material is prohibited on any other web-site or computer environment.

27. Use of “Cookies” and Other Web Technologies:
We use “cookie” technology and IP addresses to obtain non-personal information from on-line visitors, in our effort seeking to provide quality, personalized on-line experience. To do this we track information such as type of browser (e.g., Internet Explorer, Safari, Google Chrome, Mozilla Firefox, etc.) and operating system (e.g., Windows, Mac, Linux, etc.) used by the visitor, and the domain name of the visitor’s Internet service provider. We track the total number of visitors to our site in an aggregate form seeking to help us update and improve our site and keep our site fresh and interesting to visitors and help us deliver content tailored to visitor interests. A visitor may be able to disable cookies or set a browser to provide the visitor an alert when cookies are sent. This may reduce our ability to optimize visits. You waive any objection to our use of cookies or other similar technologies.

28. Errors and Corrections:
We do not warrant or represent that the Site is or will be error-free.  Data entry errors or other technical problems sometimes result in inaccurate information being shown. We reserve the right to correct any inaccuracy or typographic error, including pricing descriptions and availability of services, and shall have no liability for errors.  If a service is listed at an incorrect price or another incorrect aspect, we shall have the right to refuse or cancel any purchase of that service. We can refuse or cancel any purchase whether the purchase was confirmed and/or charged.If any of our travel arrangers make a mistake or any other human error is made in the booking process we shall make reasonable attempts to rectify these errors at the time of occurrence. ECT stands committed to providing compensation up to a maximum of the entire service fees that ECT has collected for that reservation.  All travelers must verify their reservation for accuracy and notify us of errors within 24 hours of receiving your itinerary. Beyond this 24 hour period, ECT will not be responsible for these errors

29. Changes to These Terms:
We reserve the right, in our sole discretion, to change these Terms at any time. Updated versions of the Terms will be posted here on this Site and are effective immediately on posting. The date of the newest version is posted below. Please check frequently, especially before you use this Site, to see if these Terms changed. Use of the Site after any changes to the Terms constitutes your consent to the changes.

30. User Conduct:
You agree to use the website only to obtain information on travel for purposes of considering whether to reserve travel with E-confirmation Travel.  You agree not to take any action that may compromise the security of the web-site, render the website inaccessible to others or otherwise damage the website or its content. You agree not to add to, subtract from, or otherwise modify the content, or attempt to access any content that is not intended for you. You agree not to use the website in any manner that might interfere with the rights of third parties.  You agree not to use the website in violation of these terms, in any unlawful way, or for any unlawful purpose.

31. Additional Terms and conditions:
Additional terms and conditions may apply.  Participant suppliers will provide E-confirmation Travel a confirmation number from each component of your vacation itinerary. It is your responsibility to contact the participant supplier to confirm your reservations 72 hours prior to the departure date.  The companies that furnish such services by issue electronic tickets, vouchers, and other travel documents that you receive.  Some of the participant suppliers will charge a fee for check-in and carry-on luggage; E-confirmation Travel is not responsible for these supplier additional charges.  Such tickets, vouchers, and travel documents are on terms and conditions of the respective suppliers. Often they limit or exclude liability of the supplier.  You agree to read all applicable provisions. You agree to E-confirmation Travel and participant suppliers’ applicable terms and conditions.

32. Interpretation:
These Terms are governed by and construed according to Nevada law, without giving effect to conflict of law principles.  The headings in these Terms are just for convenience to make these terms easier to use.  Headings are not allowed to be used to interpret these Terms.  These Terms are to be interpreted according to their fair meanings, and not strictly in favor of or strictly against either the traveler or the E-Confirmation Travel Manager.

33. Dispute Resolution:
Any unresolved dispute or controversy arising under or in connection with the services provided by shall be settled exclusively by arbitration, conducted before the American Arbitration Association in Las Vegas, Nevada, in accordance with the rules of that body then in effect.  The arbitrator shall not have the authority to add to, detract from, or modify any provision hereof nor to award punitive damages.  A decision by the arbitrator shall be final and binding.  Judgment may be entered on the arbitrator's award in any court having jurisdiction.  Each party shall be responsible for the fees and expenses of their legal representation and the costs of arbitration shall be shared equally.  This arbitration provision shall be subject to and the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards.

34. Governing Law and Jurisdiction:
By accessing this Site, you are electing to visit us at our host location in Nevada.  You accept jurisdiction in Nevada over any dispute that may arise from your accessing, visiting or using this Site. Subject to the arbitration requirement above, legal proceedings against Signature and its members may be instituted only in a state or federal court within the State of Nevada and any claim involved in such proceedings shall be decided in accordance with the laws of the State of Nevada irrespective of conflicts in law.  Any legal proceeding against Signature or its members must be commenced no later than one year following the date of tour completion. Neither Signature nor any affiliate shall, in any case, be liable for damages other than compensatory damages.

 

35. Complete Agreement:
Subject to the preceding paragraph, these Terms of Use are the entire agreement of the parties with respect to the subject.  E-confirmation Travel will not offer a waiver of any breach or default shall be deemed to be a waiver of any preceding or subsequent breach or default.

 

36. Severability:
If any provision(s) in these terms is determined by an arbitrator or court having jurisdiction to be invalid or unenforceable, it will not impact any other provision of this Agreement, all of which will remain in full force and effect.  All, if any disputes relating to this Agreement, E-confirmation Travel privacy policy, your use of the Site, are governed by, and will be interpreted in accordance with, the laws of the State of Nevada, without regard to any conflict of law provisions.
